1. Promoter

The promoter of the d3 “Show Us Your Tape” Competition (“Promotion”) is d3 New Zealand Limited, of 226B Bush Road, Rosedale, Auckland 0632, New Zealand (“Promoter”, “d3”, “we”, “us” or “our”).

The Promotion is administered by the Promoter from New Zealand and is offered only to eligible residents of Australia in accordance with these Terms & Conditions.

2. Eligibility

Entry is open to individuals who:

1. are aged 18 years or over at the time of entry;
2. are residents of Australia and are physically residing in Australia during the Promotional Period;
3. have a valid Instagram account; and
4. otherwise comply with these Terms & Conditions.

Employees, officers, contractors and agents of the Promoter, and any agencies or companies directly associated with the administration of the Promotion, together with members of their immediate families, are not eligible to enter.

For the purposes of these Terms & Conditions, “immediate family” includes a spouse, de facto partner, parent, child or sibling, whether natural, step or adopted.

3. Promotional Period

The Promotion commences at 7:30am AEST on 13 August 2026 and closes at 11:59pm AEST on 2 September 2026 (“Promotional Period”).

Entries and likes received after the closing time will not be counted.

The Promoter's records will be used to determine whether an Entry or like was received within the Promotional Period, subject to any evidence reasonably available to the Promoter.

4. How to Enter

To enter the Promotion, an eligible entrant must, during the Promotional Period:

1. locate the official “Show Us Your Tape” competition post published by the official d3 Instagram account;
2. take an original photograph showing a creative use of a genuine d3 product for a purpose; and
3. upload that photograph as a photo comment on the official competition post (“Entry”).

The Entry must visibly feature and/or demonstrate the use of a genuine d3 product.

Generic tape, counterfeit d3 products, tape manufactured or supplied by a competing brand, or any product represented as d3 when it is not a genuine d3 product will not qualify.

Any genuine d3 product may be used.

Only one Entry per person is permitted.

If an entrant submits more than one Entry, the Promoter may treat only the entrant's first valid Entry as eligible and disregard or remove any subsequent Entries.

5. Entry Requirements

Each Entry must:

1. be the entrant's original work, or be submitted with all rights and permissions necessary to permit its use in accordance with these Terms & Conditions;
2. genuinely depict the use of a genuine d3 product;
3. not infringe the intellectual property, privacy, publicity or other rights of any third party;
4. not contain material that is defamatory, discriminatory, threatening, obscene, sexually explicit, hateful, unlawful or otherwise inappropriate;
5. not depict, promote or encourage dangerous, reckless or unlawful conduct;
6. not depict use of d3 in a manner reasonably likely to cause injury to a person or damage to property;
7. comply with applicable laws and Instagram's applicable terms, policies and community standards; and
8. comply with any reasonable directions issued by the Promoter in connection with the Promotion.

The Promoter may remove or disqualify an Entry that it reasonably considers does not comply with these requirements.

6. AI-Generated or Manipulated Content

Entries that are wholly generated using artificial intelligence, or that have been materially generated, manipulated or altered using artificial intelligence or other technology in a manner that fabricates or misrepresents the depicted use of d3, are not eligible.

Ordinary photographic editing, including reasonable cropping, exposure, colour, contrast and similar adjustments, is permitted provided that the Entry remains a genuine representation of the scene and use of d3 photographed.

7. Other People Appearing in an Entry

Where an Entry contains an identifiable person other than the entrant, the entrant warrants that they have obtained that person's consent to:

1. being photographed;
2. the photograph being submitted to the Promotion; and
3. the photograph being used by the Promoter in accordance with these Terms & Conditions.

The entrant must be able to provide evidence of such permission if reasonably requested by the Promoter.

Entrants must not submit photographs featuring a person under 18 unless the entrant has obtained permission from that person's parent or legal guardian for the photograph and its use in accordance with these Terms & Conditions.

8. Determining the Winner

There will be one (1) winner across Australia.

Subject to these Terms & Conditions, the winner will be the eligible entrant whose Entry has received the highest number of valid Instagram likes on its photo comment on the official competition post as at 11:59pm AEST on 2 September 2026.

Only likes applied directly to the entrant's eligible photo comment on the original official competition post will count.

Likes or engagement associated with screenshots, Instagram Stories, reposts, direct messages, other Instagram posts, Facebook, TikTok or any other platform or location will not count.

Likes received after the Promotional Period closes will not count, regardless of whether they subsequently appear on Instagram.

The Promoter may record the displayed like counts of leading Entries at or immediately following the closing time, including by screenshot, screen recording or other reasonable means, for the purposes of determining and verifying the result.

9. Genuine Engagement

All likes must be genuine.

Entrants must not obtain or attempt to obtain likes through fraudulent or artificial means, including:

1. purchasing likes or engagement;
2. using bots, scripts or automated systems;
3. using fake, duplicate or artificially created accounts;
4. using engagement manipulation services;
5. hacking, technical manipulation or interference with Instagram;
6. offering payment, prizes or other improper incentives in exchange for likes; or
7. using any other method that the Promoter reasonably considers artificially manipulates the result of the Promotion.

Entrants may organically share their Entry and encourage genuine Instagram users to like their Entry.

The Promoter reserves the right to investigate suspicious engagement and to disregard invalid likes or disqualify an entrant where the Promoter reasonably believes that the entrant has manipulated or attempted to manipulate the Promotion.

The Promoter may consider information available from Instagram and any other reasonably available evidence when making this determination.

10. Tie-Break

If two or more eligible Entries have the same highest number of valid likes at the closing time, only those tied Entries will be assessed by the Promoter.

The tied Entries will be assessed based on:

1. creativity;
2. originality; and
3. relevance to the “Show Us Your Tape” campaign theme.

The Entry that the Promoter determines best satisfies those criteria will be the winner.

A random draw will not be used to determine the winner in the event of a tie.

11. Prize

The winner will receive:

1. one (1) Baseus Inspire XH1 Wireless Noise-Cancelling Headphones – Sound by Bose; and
2. AU$100 worth of d3 products.

Delivery of the Baseus Inspire XH1 Wireless Noise-Cancelling Headphones to one valid Australian delivery address nominated by the winner is included.

The Prize is not transferable, exchangeable or redeemable for cash, except where required by law.

12. Prize Availability and Substitution

The Prize is subject to availability.

If the advertised headphones become unavailable for reasons outside the Promoter's reasonable control, the Promoter may substitute the headphones with another product of equal or greater value, subject to applicable law.

Any difference in value between the advertised headphones and a substituted product will not be payable in cash.

The d3 product component of the Prize will remain valued at AU$100.

13. Baseus and Bose Disclaimer

Baseus and Bose are not sponsors of, and are not affiliated or associated with, this Promotion.

The inclusion of the Baseus Inspire XH1 Wireless Noise-Cancelling Headphones – Sound by Bose as part of the Prize does not imply sponsorship, endorsement, administration or association between Baseus, Bose, the Promotion or the Promoter.

All third-party product names, brands and trademarks remain the property of their respective owners.

14. Winner Notification

The provisional winner will be contacted by direct message from the official d3 Instagram account after the Promotion has closed.

The provisional winner may be required to provide information reasonably necessary for the Promoter to verify their identity, age, Australian residency, eligibility, compliance with these Terms & Conditions and delivery details.

The provisional winner must respond to the Promoter within five (5) business days of the Promoter's initial direct message.

A person will not be confirmed as the winner until the Promoter has reasonably verified their eligibility and compliance with these Terms & Conditions.

15. Unclaimed or Invalid Prize

If the provisional winner:

1. does not respond within five (5) business days;
2. cannot reasonably establish their eligibility;
3. has breached these Terms & Conditions;
4. cannot provide a valid Australian delivery address;
5. declines the Prize; or
6. is otherwise unable to accept the Prize,

the Promoter may deem that entrant ineligible or to have forfeited the Prize.

In that event, the Prize will be offered to the eligible Entry with the next-highest number of valid likes as recorded at the original closing time, subject to verification under these Terms & Conditions.

This process may continue until an eligible winner accepts the Prize.

16. Winner Announcement

Once the winner has been contacted and their eligibility has been confirmed, the Promoter intends to announce the winner through the official d3 Instagram account, including through Instagram Stories.

By entering, entrants acknowledge that, if they win, their Instagram username, Entry and/or first name may be publicly announced and the winning Entry may be reposted by d3.

17. Intellectual Property and Use of Entries

Entrants retain ownership of the copyright and other intellectual property rights they hold in their Entries.

By submitting an Entry, each entrant grants the Promoter a non-exclusive, worldwide, royalty-free licence to reproduce, publish, communicate, display, repost, adapt for formatting purposes and otherwise use the Entry:

1. to administer, operate and promote the Promotion;
2. on d3's websites and organic social-media channels;
3. in connection with announcing or promoting the winner and other Entries; and
4. in future organic d3 marketing and promotional communications.

This licence does not transfer ownership of the Entry to the Promoter.

The Promoter will not, solely by virtue of these Terms & Conditions, acquire an unrestricted right to use an entrant's Entry in paid advertising campaigns unrelated to the Promotion.

Where reasonably practicable, d3 may credit or tag the entrant when reposting an Entry on social media.

18. Entrant Warranties

By entering, each entrant represents and warrants that:

1. they are entitled to submit the Entry;
2. the Entry complies with these Terms & Conditions;
3. the Entry does not knowingly infringe any third-party rights;
4. any permissions required from people appearing in the Entry have been obtained; and
5. any information provided to the Promoter in connection with the Promotion is true and accurate.

19. Safety and Use of d3

The Promotion encourages creative uses of d3. However, entrants remain responsible for ensuring that anything they depict or undertake is safe, lawful and appropriate.

The Promoter's acceptance, display, liking, commenting on, sharing, reposting or publication of an Entry does not constitute a representation or endorsement that the depicted use of d3 is safe, medically appropriate, recommended or suitable for any particular purpose.

Nothing in the Promotion constitutes medical advice.

20. Disqualification and Integrity of the Promotion

The Promoter reserves the right, acting reasonably, to verify Entries and entrants and to disqualify an entrant who:

1. breaches these Terms & Conditions;
2. tampers or attempts to tamper with the entry or winner-determination process;
3. submits false or misleading information;
4. manipulates or attempts to manipulate engagement;
5. interferes with the fair and proper conduct of the Promotion;
6. engages in conduct reasonably considered fraudulent, unlawful or inappropriate; or
7. otherwise gains an unfair advantage over other entrants contrary to these Terms & Conditions.

Where practicable, decisions concerning disqualification will be based on reasonably available evidence.

21. Instagram Disclaimer

This Promotion is in no way sponsored, endorsed, administered by or associated with Instagram or Meta.

By entering, each entrant acknowledges that they are providing their information to the Promoter and not to Instagram for the purposes of administering the Promotion.

To the extent permitted by law, entrants release Instagram from claims arising solely from the administration of this Promotion by the Promoter.

Entrants remain responsible for complying with Instagram's applicable terms and policies.

22. Instagram Availability and Technical Issues

The Promoter does not control Instagram and cannot guarantee the continuous availability or operation of Instagram's comments, photo comments, like counts or other functionality.

If Instagram experiences an outage, removes an Entry, alters the display of likes, changes functionality or another technical issue occurs that materially affects the Promotion, the Promoter may take reasonable steps necessary to preserve the fairness and integrity of the Promotion, subject to applicable law.

The Promoter is not responsible for Entries or likes that are not received or correctly displayed because of technical failures outside its reasonable control, except to the extent liability cannot lawfully be excluded.

23. Modification, Suspension or Cancellation

If the Promotion cannot be conducted as reasonably anticipated because of circumstances beyond the Promoter's reasonable control, including fraud, widespread manipulation, technical failure, platform changes, security issues, natural disaster or other circumstances affecting the integrity or proper administration of the Promotion, the Promoter may modify, suspend or cancel the Promotion to the extent reasonably necessary, subject to applicable law.

The Promoter will not exercise this right in a manner intended to unfairly disadvantage entrants.

24. Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable law.

Subject to those rights, and to the maximum extent permitted by law, the Promoter is not responsible for loss, damage or injury arising from circumstances outside its reasonable control in connection with participation in the Promotion or acceptance or use of the Prize.

Nothing in these Terms & Conditions is intended to exclude liability that cannot lawfully be excluded.

25. Personal Information and Privacy

The Promoter may collect personal information from entrants and the winner for the purposes of administering the Promotion, verifying eligibility, contacting and announcing the winner, delivering the Prize, dealing with enquiries or disputes and otherwise administering the Promotion.

Information collected may include an entrant's Instagram username and Entry and, for a provisional winner, their name, age verification information, contact details and Australian delivery address.

Because the Promoter is based in New Zealand, personal information relating to the Promotion may be accessed, used or stored by the Promoter in New Zealand for the purposes described above.

The Promoter will use personal information for purposes connected with the Promotion and other purposes permitted or required by applicable law. Any use of an Entry for marketing purposes is also subject to the licence in clause 17.

Entrants should not publicly post their residential address, telephone number or other unnecessary personal information in their competition comment. Information required for Prize fulfilment will be requested privately from the provisional winner.

26. Promoter's Decisions

Where these Terms & Conditions require the Promoter to make a determination, including in relation to eligibility, validity of engagement, a tie-break or suspected manipulation, the Promoter will make that determination reasonably and having regard to available evidence and these Terms & Conditions.

Nothing in this clause limits any rights an entrant may have under applicable law.

27. Acceptance of Terms

By entering the Promotion, each entrant is deemed to have read, understood and agreed to these Terms & Conditions.

If an entrant does not agree to these Terms & Conditions, they should not enter the Promotion.

28. Governing Law

These Terms & Conditions and the Promotion are subject to all applicable laws and regulations in Australia, including the Australian Consumer Law and any mandatory laws applicable in the Australian State or Territory in which an entrant resides.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any mandatory rights or protections available to an entrant under applicable Australian law.
